Terms of Use & Privacy Policy

1. Who we are

CreaSolaCon is operated by Creative Solutions and Consultations OÜ, registry code 16117402, VAT number EE102677988, Õismäe tee 141, 13518 Tallinn, Estonia (“we”, “us”). Contact: info@creasolacon.ee. These terms are governed by the Estonian Law of Obligations Act, the Consumer Protection Act, the Information Society Services Act and applicable EU law, including the Digital Services Act (EU 2022/2065), the Platform-to-Business Regulation (EU 2019/1150) and the General Data Protection Regulation (EU 2016/679, “GDPR”).

2. The service

CreaSolaCon is an online marketplace connecting clients with independent providers of photography studios, photography services and masterclasses. We are not a party to the service contract between client and provider; the provider alone is responsible for delivering the booked service. Each listing identifies whether the provider acts as a business (trader). Consumer-protection rights against a provider apply only where the provider is a trader.

3. Accounts

You must be at least 18 years old and give accurate information. You are responsible for keeping your login secure and for activity on your account. We may suspend or close accounts that breach these terms, giving reasons as required by EU law.

4. Provider obligations

Providers must complete identity and payout verification with our payment partner Stripe before listings go live, describe services, prices and availability truthfully, hold any licences, insurance and tax registrations required, and comply with consumer law. Providers are responsible for their own taxes, including VAT. Listing ranking is based on relevance to the search, location, availability, price and reviews; no paid ranking is used.

5. Bookings, prices and fees

Studio slots and masterclass tickets can be booked instantly. Photographer services are booked by accepting a quote sent in chat. A binding contract with the provider is formed when your payment is confirmed.

Providers receive 100% of their listed or quoted price. Clients pay a service fee of €0.30 + 6% of the provider price, with a minimum fee of €1.50. The total price, including the fee, is shown before you pay. Prices are in euros.

6. Payments and payout protection

Payments are processed by Stripe. We hold the payment and release it to the provider automatically 36 hours after the event ends, unless the client reports an issue before then, in which case the payout is paused until the issue is resolved.

7. Cancellations and right of withdrawal

Under the EU Consumer Rights Directive and the Estonian Law of Obligations Act, the 14-day right of withdrawal does not apply to leisure-related services (such as studio rental and event tickets) provided on a specific date or period. Cancellation is therefore governed by the provider’s cancellation policy shown on the listing. Where a provider cancels, the client receives a full refund including the service fee.

8. Issues and disputes

If something goes wrong, report an issue from your booking before the payout is released. Client and provider are encouraged to resolve it in chat. If they cannot, either may escalate to us; we review the evidence and may release funds to the provider, refund the client in full, or split the amount. Our decision does not limit your statutory rights or your right to go to court.

9. Content and intellectual property

You keep ownership of photos and text you upload and grant us a non-exclusive, royalty-free licence to host and display them to operate and promote the marketplace while they are online. You confirm you have the rights to everything you upload, including consent from people shown in photos. Reviews must reflect genuine experiences.

10. Prohibited conduct

You must not: post illegal, misleading or infringing content; harass others; arrange payment outside the platform to avoid fees or protection; create fake reviews; or interfere with the service’s security.

11. Liability

We are liable for the operation of the platform with reasonable care. We are not liable for the providers’ services, except as required by law. Nothing in these terms limits liability for intent, gross negligence, death or personal injury, or any rights consumers have under mandatory law.

12. Notices and illegal content (DSA)

Anyone may report content they consider illegal by writing to info@creasolacon.ee with the location of the content and an explanation. We act on notices promptly, inform you of our decision and its reasons, and you may contest decisions through our internal complaint process. Our single point of contact for authorities and users is info@creasolacon.ee; languages: English and Estonian.

15. Governing law and complaints

These terms are governed by Estonian law. If you are a consumer, you also keep the protection of mandatory laws of your country of residence and may bring claims in your local courts. Consumers may contact the Estonian Consumer Disputes Committee (Tarbijavaidluste komisjon, www.ttja.ee) or use the EU Online Dispute Resolution resources. Business users may use mediation in line with the Platform-to-Business Regulation.

16. Changes

We may update these terms. We will notify registered users at least 15 days before material changes take effect (as required for business users), and continued use after that date means acceptance.
